Terms of Service

These terms govern your use of Liveline, the Live Intent™ scoring service operated by Phishr Limited (trading as Everhold). By creating an account or using Liveline, you agree to them. If you're agreeing on behalf of a company, you confirm you're authorised to bind it.

1. The service
Liveline is a scoring layer. You bring a list of contacts and phone numbers; we waterfall-enrich and score each number for how likely it is to answer a call, and hand back a ranked Live / Maybe / Dead list into your own stack.
Liveline never places calls. We are an intelligence layer, not a dialer, data vendor, or calling service. Your reps and your own dialer make every call. We do not patch through, auto-dial, or contact your prospects on your behalf.
2. Accounts & eligibility
You must be at least 18 and use Liveline for legitimate business purposes. You're responsible for the accuracy of your account information, for keeping your credentials secure, and for all activity under your account. Tell us promptly at support@everholdhq.com if you suspect unauthorised use.
3. Acceptable use
You agree that you will:
- Only upload contact data you have the lawful right to process, and have a valid lawful basis to enrich and score.
- Comply with all laws that apply to you when you later contact those numbers — including telephone-marketing, do-not-call (DNC), consent, and calling-window rules in the relevant jurisdiction. Compliance for the calls you make is your responsibility, not ours; Liveline scores numbers and does not dial them.
- Not use Liveline to harass, defraud, or unlawfully contact anyone, nor to build a competing scoring product.
- Not reverse-engineer, scrape, overload, resell, or circumvent the service or its usage limits, nor misuse our API.
We may suspend or limit accounts that breach these rules or put the service, our vendors, or others at risk.
4. Your data & ownership
You own the contact data you upload and the scored results we return to you. You grant us a limited licence to process that data solely to provide and improve the service for you, as described in our Privacy Policy. For data you upload, you are the controller and we act as your processor. We may use aggregated, de-identified data that does not identify you or any individual to operate and improve Liveline.
5. Credits, plans & billing
- Credits. Scoring is metered in credits, where 1 credit = 1 contact scored. Paid plans include a monthly credit allowance; unused credits roll over to the next month, up to a cap of 2× your monthly allowance, and you can top up with per-credit packs.
- Billing. Plans are billed in advance, monthly or annually, through our payment processor (Stripe). Annual plans are discounted as shown at checkout. Prices are exclusive of taxes unless stated.
- Renewal & cancellation. Subscriptions renew automatically until cancelled. You can cancel anytime; cancellation takes effect at the end of the current billing period and you keep access until then.
- Refunds. Except where required by law or expressly stated (see the guarantee below), fees are non-refundable, and credits have no cash value.
- Changes. We may change pricing or plans with reasonable notice; changes take effect on your next renewal.
6. Free scoring & guarantee
New accounts can score up to 250 contacts free, with no card required. Free scoring is provided "as is" and we may change or end it at any time. Any satisfaction or connect-rate guarantee is offered only as described on our pricing page at the time of your purchase, and is subject to the terms stated there.
7. Performance & results
Liveline improves the odds that the numbers you dial are live — it does not guarantee any specific connect rate, answer rate, meeting, or revenue outcome. Scores are probabilistic estimates based on third-party data and signals that change over time, and your results depend on your list, your reps, your offer, and how you use the output. Marketing figures and the ROI calculator on our website are illustrative, not promises.
8. Intellectual property
Liveline, including its software, scoring models, design, and brand (including "Liveline" and "Live Intent™"), is owned by Phishr Limited and protected by law. We grant you a limited, non-exclusive, non-transferable right to use the service under these terms. We welcome your feedback and may use it freely without obligation to you.
9. Availability & changes
We work to keep Liveline available and reliable, but we don't guarantee uninterrupted service. We may modify, add, or remove features, and we may perform maintenance that causes downtime. We may rely on third-party data vendors whose availability and accuracy are outside our control.
10. Disclaimer of warranties
To the fullest extent permitted by law, Liveline is provided "as is" and "as available", without warranties of any kind, whether express or implied, including fitness for a particular purpose, accuracy, or non-infringement. We do not warrant that the service or any score will be error-free or meet your requirements.
11. Limitation of liability
To the fullest extent permitted by law, Phishr Limited will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill. Our total aggregate liability arising out of or relating to the service is limited to the amount you paid us in the 12 months before the event giving rise to the claim. Nothing in these terms excludes liability that cannot be excluded under law.
12. Indemnity
You agree to indemnify and hold harmless Phishr Limited from any claims, losses, and costs arising out of your use of the service, the data you upload, the calls you make, or your breach of these terms or of any applicable law — including telephone-marketing, do-not-call, and data-protection rules.
13. Term & termination
These terms apply while you use Liveline. You may stop and close your account at any time. We may suspend or terminate access if you breach these terms, fail to pay, or use the service in a way that creates risk or legal exposure. On termination, your right to use the service ends; provisions that by their nature should survive (including ownership, disclaimers, liability, and indemnity) will survive.
14. Governing law
These terms are governed by the laws of England and Wales, and the courts of England and Wales have exclusive jurisdiction over any dispute, without prejudice to any mandatory consumer rights you may have where you live.
